ARTICLE 1: Purpose and Scope

These Terms and Conditions of Sale exclusively govern the contractual relationship between Mohamed Ennasser, sole proprietor (hereinafter "the Seller" or "the Publisher") and any natural or legal person purchasing a premium subscription on the SphereAstrale.com website (hereinafter "the Buyer" or "the Customer").

Any order implies full and complete acceptance of these Terms by the Customer.

ARTICLE 3: Products and Services

3.1. Service Description

The Seller offers a monthly premium subscription service providing access to:

  • 50 credits per day (instead of 15 for free users or 8 for visitors)
  • Complete history : Access to all your past encrypted consultations (including those made before subscription)
  • Priority access : Priority service during high traffic
  • Premium support : Priority customer assistance
  • Advanced features : Priority access to new features

3.2. Technical Service Details

  • Daily credits: 50 credits renewed daily at 00:00 (Paris time), non-cumulative
  • New consultation: 4 credits to start a session
  • Messages: 2 credits per message sent (AI response included)
  • Limit per consultation: 40 messages maximum (vs. 10 for free users)
  • Character limit: 500 characters maximum per message
  • History: Full access to all encrypted conversations (past and future)
  • Deletion: Ability to delete history at any time
  • Export: Download your personal data (GDPR)

3.3. Nature of Service

IMPORTANT: The psychic service is fully automated and generated by artificial intelligence (OpenAI GPT). It is an entertainment and leisure service only. The responses do not constitute professional advice (medical, psychological, legal, financial) and should not be used as such.

ARTICLE 4: Price and Payment Terms

4.1. Price

Monthly Premium Subscription: €24.99 incl. tax

The price is expressed in euros, all taxes included. As a sole proprietor under the micro-enterprise scheme, the Seller is not subject to VAT.

4.2. Payment Terms

Payment is made exclusively by credit card via the secure Stripe platform. Payment is due immediately upon ordering.

Bank details are not stored on the Seller's servers but only by the payment provider Stripe, PCI DSS certified.

4.3. Renewal

The subscription renews automatically each month on the same date, unless cancelled by the Customer at least 24 hours before the renewal date.

ARTICLE 5: Order and Confirmation

5.1. Order Process

To subscribe to the premium subscription, the Customer must:

  1. Create a user account or log in
  2. Select the premium subscription
  3. Proceed with payment via Stripe
  4. Receive confirmation by email

5.2. Confirmation

Once payment is validated, the Customer immediately receives:

  • An order confirmation email
  • Automatic activation of their premium subscription
  • Access to premium credits (50/day)

ARTICLE 6: Delivery and Execution

As the service is digital, "delivery" is immediate upon payment validation. Premium access is automatically activated on the Customer's account.

In case of technical issues delaying activation, the Customer will be notified by email and activation will be completed within 24 hours maximum.

ARTICLE 7: Right of Withdrawal

In accordance with Article L221-28 12° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of a service fully performed before the end of the withdrawal period and whose execution began after the consumer's express prior consent and express waiver of their right of withdrawal.

As the service is immediately available and usable upon payment, and the Customer having expressly accepted this immediate execution when ordering, no right of withdrawal may be exercised.

ARTICLE 8: Cancellation

8.1. Cancellation by Customer

The Customer may cancel their subscription at any time from their personal space. Cancellation takes effect at the end of the current billing period, with no refund for the period already paid.

8.2. Cancellation by Seller

The Seller may cancel the subscription in case of:

  • Non-payment or payment default
  • Fraudulent or abusive use of the service
  • Violation of Terms of Use
  • Inappropriate behavior or harm to the service

Cancellation takes effect immediately, with no refund.

ARTICLE 9: Warranties and Liability

9.1. Warranties

The Seller commits to providing a service conforming to the description and accessible 24/7, subject to maintenance operations.

As the service is based on artificial intelligence, the Seller cannot guarantee:

  • The relevance or accuracy of the responses provided
  • The absence of interruptions due to external factors (OpenAI, host, etc.)

9.2. Limitation of Liability

As the service is intended for entertainment, the Seller disclaims all liability for:

  • Decisions made by the Customer based on consultations
  • Direct or indirect damages resulting from use of the service
  • Service interruptions due to external causes

In any event, the Seller's liability is limited to the amount of the subscription paid by the Customer.

ARTICLE 10: Personal Data

Personal data collected in connection with the order is processed in accordance with our Privacy Policy and GDPR.

Billing data is retained for 10 years in accordance with accounting obligations.

ARTICLE 11: Force Majeure

The Seller cannot be held liable for any delay or failure to perform resulting from a force majeure event, including:

  • OpenAI service outages
  • Host failure
  • Natural disaster, war, strike, etc.

ARTICLE 12: Modification of Terms

The Seller reserves the right to modify these Terms at any time. The new conditions will apply to orders placed after their publication online.

Customers will be informed of significant changes by email.

ARTICLE 13: Mediation and Disputes

13.1. Mediation

In case of dispute, the Customer may use the consumer mediation service free of charge:

13.2. Applicable Law

These Terms are governed by French law. Any dispute will be subject to the jurisdiction of the competent courts of Paris.
